RSMECHS does not provide mechanical services, does not employ Mechanics, and does not carry insurance covering the Services performed by Mechanics. Please read this policy carefully before using the Platform.

As an independent contractor, each Mechanic bears full legal and financial responsibility for the Services they provide through the Platform, including:
Mechanics may face professional indemnity claims where their advice, diagnosis, or work causes financial loss to a Customer — for example, an incorrect diagnosis leading to unnecessary repairs. Mechanics are strongly advised to carry professional indemnity insurance to cover such claims.
Each Mechanic agrees to indemnify RSMECHS against any claims, losses, or expenses (including legal fees) that arise from claims made against RSMECHS as a result of the Mechanic's Services. This includes any third-party claims or regulatory actions arising from the Mechanic's conduct.
Customers are responsible for:
Customers who provide false information that leads to a Mechanic attending unnecessarily or performing incorrect work may be liable to the Mechanic for costs incurred. False or malicious dispute claims may result in account suspension and potential legal action.
RSMECHS strongly recommends, and in some jurisdictions legally requires, that all Mechanics maintain adequate insurance. The following types of insurance are relevant:
Covers claims from third parties (including Customers) for bodily injury or property damage caused by you or your business activities.
Covers claims arising from errors, omissions, or negligence in the professional services you provide — including incorrect diagnosis or advice that leads to financial loss.
Specifically covers damage to customer vehicles while in your care, custody, or control. Essential for mobile mechanics who take custody of vehicles.
Covers your vehicle when used for business purposes. Standard personal auto insurance typically excludes commercial use. If you drive to job sites, you need commercial coverage.
Covers you if you are injured while performing Services. As an independent contractor, you are not covered by employer's workers' compensation. This is your equivalent protection.
Covers theft or damage to your professional tools and equipment. As an independent contractor, you are responsible for your own tools and RSMECHS does not provide any cover.
RSMECHS does not verify whether individual Mechanics hold insurance unless specifically requested. Operating without adequate insurance is at the Mechanic's own risk and may result in significant personal financial liability in the event of a claim.
Customers should be aware of the following regarding their own vehicle insurance:
Customers have the right to request proof of insurance from their Mechanic before authorising any work. We encourage this practice for major repairs. Mechanics are expected to provide proof of insurance upon reasonable request. If a Mechanic refuses to provide proof of insurance, consider whether you wish to proceed with the booking.
Tip: For major repairs such as engine work, transmission, or electrical systems, always request proof of both public liability and professional indemnity insurance from your Mechanic before the work begins.
If you believe a Mechanic has caused damage to your vehicle during a Service, take the following steps immediately:

If you or anyone else is injured during a Service, seek medical attention immediately. Call emergency services if needed. Report the incident to RSMECHS at safety@rsmechs.com as soon as it is safe to do so.
If a Customer is injured as a result of a Mechanic's negligence or unsafe working practices:
As an independent contractor, a Mechanic injured while performing Services:
Where Services result in injury or damage to a third party (for example, a passer-by injured by tools left on the ground, or a neighbouring vehicle damaged), the Mechanic as service provider bears primary liability. The Mechanic's public liability insurance is designed to respond to such claims.
RSMECHS is not liable for third-party claims arising from Services. If RSMECHS is included in any third-party claim as platform operator, the Mechanic agrees to indemnify RSMECHS in accordance with the Contractor Agreement.

This table provides general guidance only. Insurance requirements change frequently. Mechanics are responsible for verifying current requirements in their specific jurisdiction with a qualified insurance broker or legal advisor.
At this stage, RSMECHS requires Mechanics to declare their insurance status during the application process. RSMECHS does not independently verify insurance documents for every Mechanic prior to approval.
RSMECHS reserves the right to request proof of insurance from any Mechanic at any time. Failure to provide satisfactory proof within 5 business days of a request may result in account suspension.
Customers who wish to verify a Mechanic's insurance should request proof directly from the Mechanic before authorising work. RSMECHS can facilitate this request but cannot guarantee the accuracy or currency of insurance documents held on file.
RSMECHS intends to implement mandatory insurance verification for all Mechanics as the platform scales. Mechanics will be notified of any new verification requirements with reasonable advance notice.
All incidents must be reported to RSMECHS promptly. Use the appropriate channel based on the type of incident:

Prompt reporting allows RSMECHS to provide appropriate support, preserve evidence, and ensure that insurance claims are handled correctly. Delayed reporting may prejudice insurance claims and dispute outcomes.
